1. Acceptance of Terms

By registering with NativEnglish, you agree to comply with these Terms & Conditions, our Privacy Policy, Refund Policy, and Disclaimer. If you do not agree with any part of these terms, you should not use our services.

2. Course Enrollment

• Enrollment is confirmed only after successful payment of the applicable course fee.
• Students are responsible for providing accurate and complete registration details.
• NativEnglish reserves the right to accept, reject, suspend, or terminate any enrollment at its sole discretion where necessary to protect the interests of the institution.

3. Fees & Payment

• Course fees must be paid before the due date unless otherwise agreed in writing.
• Prices are subject to change for future enrollments without prior notice.
• Applicable taxes, if any, shall be charged in accordance with Indian law.

4. No Refund Policy

All fees paid to NativEnglish are final and non-refundable.

Refunds will not be provided for reasons including, but not limited to:

• Change of mind
• Personal commitments
• Lack of attendance
• Schedule conflicts
• Technical issues on the student's side
• Partial completion of the course
• Dissatisfaction arising from insufficient personal practice or effort

Once payment has been made, it cannot be cancelled, refunded, transferred, or adjusted except where required under applicable law.

5. Class Attendance

Students are expected to attend classes regularly and punctually.

Missed classes due to student absence may not be rescheduled unless specifically provided under the enrolled programme.

Repeated absenteeism may affect learning outcomes and eligibility for course completion certificates.

6. Recording Policy

To protect the privacy of our tutors, students, and proprietary teaching methods, students are strictly prohibited from:

• Audio recording classes
• Video recording classes
• Screen recording classes
• Taking screenshots for public distribution
• Live streaming any class
• Sharing classroom content with third parties

Violation of this policy may result in immediate termination of enrollment without refund and may lead to copyright enforcement or legal action.

7. Intellectual Property

All educational materials including:

• PDFs
• Worksheets
• Lesson plans
• Videos
• Presentations
• Course frameworks
• Teaching methodologies
• Website content
• Logos
• Graphics
• Branding

are the exclusive intellectual property of NativEnglish.

Students may not reproduce, copy, distribute, upload, sell, publish, modify, or commercially exploit any material without prior written permission.

8. Student Code of Conduct

NativEnglish is committed to maintaining a safe, respectful, and professional learning environment for all students and tutors. Every student is expected to behave with courtesy, integrity, and mutual respect throughout the duration of the course.

Students must not:

• Use abusive, offensive, threatening, defamatory, discriminatory, or obscene language.
• Harass, intimidate, insult, or disrespect tutors, staff members, or fellow students.
• Intentionally disrupt classes or interfere with the learning experience of others.
• Engage in bullying, hate speech, harassment, or any inappropriate conduct.
• Share false, misleading, defamatory, or malicious information about NativEnglish, its tutors, employees, or students.
• Misuse tutors' personal or professional contact information.
• Contact tutors outside authorised communication channels without permission.
• Attempt to solicit tutors or students for personal, commercial, or competing educational purposes.
• Engage in any conduct that damages the reputation, goodwill, or professional environment of NativEnglish.

Failure to comply with this Code of Conduct may result in disciplinary action, including suspension or termination of enrollment.

9. Zero Tolerance for Misconduct Towards Tutors

NativEnglish maintains a strict zero-tolerance policy regarding any misconduct directed toward its tutors, staff members, or representatives.

Any student engaging in any of the following conduct may face immediate disciplinary action:

• Verbal abuse
• Threats or intimidation
• Sexual harassment
• Physical threats
• Defamation
• Cyberbullying
• Stalking
• Sending offensive or inappropriate messages
• Sharing private information without consent
• Obscene, vulgar, or indecent behaviour
• Any conduct that compromises the dignity, safety, reputation, or professional environment of our tutors or staff

Depending on the seriousness of the violation, NativEnglish reserves the right to take one or more of the following actions:

• Immediate removal from the course without refund.
• Permanent suspension from all current and future NativEnglish programmes.
• Blocking access to classes, study materials, and online platforms.
• Reporting the incident to the relevant law enforcement or regulatory authorities where appropriate.
• Initiating civil or criminal legal proceedings under applicable laws of India.

NativEnglish is committed to providing a safe and respectful workplace for all tutors and staff, and any misconduct will be dealt with firmly.

10. Online Conduct

Students attending online classes agree to:

• Join sessions using their registered name and identity.
• Maintain respectful and professional communication at all times.
• Keep their microphone muted when requested by the tutor.
• Avoid sharing meeting IDs, passwords, or access links with unauthorised persons.
• Ensure that no unauthorised person attends classes using their account.
• Refrain from posting inappropriate messages, images, videos, or content during classes.
• Respect the privacy of tutors and fellow students.
• Participate in a manner that supports a positive learning environment.

NativEnglish reserves the right to remove any participant who disrupts online sessions.

11. Technical Requirements

Students are responsible for ensuring they have adequate equipment to participate in online learning. This includes:

• A stable internet connection.
• A computer, tablet, or smartphone compatible with the learning platform.
• A functioning microphone and speakers or headset.
• Updated software required to access classes.

NativEnglish shall not be responsible for interruptions, missed classes, or learning difficulties arising from:

• Poor internet connectivity
• Power failures
• Device malfunction
• Software incompatibility
• Technical issues on the student's side

12. Tutor Replacement

To maintain continuity and quality of instruction, NativEnglish reserves the right to assign, replace, or change tutors whenever reasonably necessary due to:

• Scheduling requirements
• Operational needs
• Illness or emergency
• Leave of absence
• Staff availability
• Other unforeseen circumstances

Such changes shall not constitute grounds for cancellation or refund.

13. Use of Session Content & Brand Assets

NativEnglish retains full ownership of all course content, lesson plans, teaching materials, tutor presentations, brand assets, logos, trademarks, website content, and educational resources.

Students are not permitted to:

• Record classes.
• Publish classroom content online.
• Upload tutor images or videos.
• Use NativEnglish's logo or branding.
• Reproduce course material.
• Use tutor names, voices, teaching style, or educational frameworks for commercial purposes.

Any unauthorised use may result in copyright enforcement, account termination, and legal action.

14. Hyperlinking to Our Website

Government agencies, recognised educational institutions, search engines, accredited business directories, and reputable news organisations may link to www.nativenglish.org, provided such links:

• are truthful and not misleading;
• do not falsely imply sponsorship, endorsement, or affiliation;
• are relevant to the context of the linking website; and
• do not harm the reputation of NativEnglish.

Other organisations wishing to link to our Website should obtain prior written approval by contacting us.

Permission to link to our Website does not grant permission to use our logo, trademarks, or branding without separate written authorisation.

15. Use of Our Name, Logo and Brand

Permission to link to our Website does not grant permission to use the NativEnglish name, logo, trademarks, graphics, branding, or other visual assets.

No logo, trademark, artwork, marketing material, or other brand asset may be reproduced or displayed without prior written authorization from NativEnglish.

Students are strictly prohibited from:

• recording live classes;
• taking screen recordings;
• capturing audio recordings;
• sharing screenshots of classroom sessions for public distribution;
• uploading classroom content to YouTube, Instagram, Facebook, LinkedIn, X (Twitter), WhatsApp, blogs, websites, or any other platform;
• distributing or selling our educational content.

Any unauthorized recording, reproduction, publication, or distribution may result in immediate suspension or termination of services without refund and may lead to copyright enforcement or legal proceedings where appropriate.

18. Website Disclaimer & Limitation of Liability

The information available on www.nativenglish.org is provided for educational and informational purposes only.

While every effort is made to ensure accuracy, NativEnglish does not guarantee that all information on the Website is complete, current, or error-free.

We do not guarantee:

• English fluency within a specific timeframe;
• Success in interviews or examinations;

Individual progress depends upon attendance, effort, participation, practice, consistency, and personal commitment.
